office was just here to take that woman's body away, identify her, and make sure her family knows what happened. the woman was struck on north tenth street, east santa clara. the driver was going in a southbound direction. police say the woman was in the crosswalk when she was hit by a white van. the woman died here on the street. she is the third pedestrian killed by a driver in san jose this year. that driver did not stop and their i had it not known at this point. they put up a placard at this location asking anyone who saw something to report it. we know there are businesses in the area likely with surveillance. hopefully that will help. we do know again there could be other witnesses. if you have any information, do call the san jose police department. in san jose, kris sanchez, "today in the bay." >> thanks for the latest. >> in theory, today could be the last day of the federal

shutdown. >> more likely another day in the 34-day stalemate. no end in sight. happening senate lawmakers expected to vote on two separate plans to reopen the federal government. one is a gop led plan, the other authored by democrats. neither is expected to receive the minimum number of votes. the white houses now set to be preparing for a shutdown lasting through march or early april. yesterday the president postponed the state of the union address. that's an indication both sides are dug in. big win for 49ers, big loss for public schools. property value of levi's stadium reduced and the county on the hook for millions-of-dollars. almost $40 million will be refunded to the 49ers. >> reporter: the santa clara board has cut the assessment in half, so the team is being assessed really only during football season. though it makes some mope from

concerts and controls events year-round. >> if i controlled all of the events that happened in the stadium outside football, i have a value. i think that's what assessment appeals board ignored. >> $36 million has to be refunded to the team from the county, $13 million from the schools which also lose out on $2.5 annually going forward. the district says no programs will be cut. >> fortunately santa clara unified has very prudent fiscal policies and we have sufficient reserves for economic uncertainti uncertainties. so we're able to come are that in year. >> the folks have an assessment for this assessment. >> that money has to go to the school or something leak that, not back to the front-runners 49ers say they accept and will cooperate fully with the assessor's office. the board may have been

overwhelmed by the mile high mountains of minutiae in the public/private contract between the team and the city of santa clara. >> i think it's not the niners that's the problem here, it the assessment appeals pord that simply did not understand the transaction. >> terry mcsweeney, "today in the bay." >> one san francisco leader fed up with store front has a novel idea about how to fill them. change the landlord to keep them that way. that problem, some of those properties have been vacant for months. that's because no one can afford the high rent. supervisor aaron peskin is proposing an answer here, taxes landlords $250 each day a property sits empty longer than six months. he believes it will generate business. he hopes to place it on the november ballot. bay area businesses fearing they will have to eat a lot of unpaid debt. this after the surprise and sudden closure of munchery.

if you haven't heard, it's a big problem. they tried to deliver specially prepared meals. they loved the idea. this week it went bust after months and months of struggles. san francisco bake shop worked with munchery. the owners say they are owed a lot of dough. not what you cook with but $20,0 $20,000. >> $20,000 is a full payroll for us. it's half my annual salary. it's the money we had been saving to make improvements, buy equipment, so it is pretty devastating. >> the owners say the only reason they learned mumplgery was closing was because of an e-mail palace out to customers. munchery not talking about the money it owes vendors and food suppliers. next time you're driving through the central valley, don't mistake the guy selling jewelry on the side of the road

for a zale's. people parking on the side flag down people and say they need gas or some other reason, then they try to use jewelry. it's not real. they say it's not here in the bay area. hold off on my valentine's day president pulling over to the side of the road. >> 4:37. we're all familiar with the price hike on those things we need and enjoy, but how about a price cut? we'll tell you about the streaming service that is reducing the prices its customers pay. >> plus, a delivery with a smile, not an option for this new service but it's something this might make you smile. you could soon see amazon's new delivery robot.

good morning. i'm frank holland with cnbc headlines. wall street set to open after a modest swing yesterday. they close higher with dow rising 171 points. upbeat earnings from heavyweights such as procter & gamble and ibm helped to ease fierce about slowdown in global economy and trade tensions between u.s. and china. on today's watch list, new filings from unemployment and earnings from american airlines, southwest and starbucks. hulu cutting the price of its

most popular streaming plan by $2. it will now be $6 a month. that's for a basic ad supported package. hulu's version will stay at $12, live tv option a small price hike from $40 to $45 a month. the changes come a week after netflix hiked prices on its streaming plans. new prices take affect february 26th for new subscribers and sometime after that for existing customer. hulu has more than 24 million subscribers in the u.s. . amazon is testing a new way to deliver packages by robot. the amazon scout is a self-driving device that will soon be on the streets of a seattle suburb. it's about the size of a cooler on wheels. it has the ability to navigate around people, pets and anything else in its way. amazon says the scout will follow a delivery route all by itself but will initially be accompanied by an employee. those are your cnbc headlines. back to you. >> good luck navigating around my kids. >> or someone just picking it

. good morning, dublin. seeing a live look outside. mike has his eyes on the roadways for us. we'll see about that. coming up, a quarter to 5:00 right now. >> here is something spectacular. it's a tradition the bay area will probably never be able to offer like geneva's annual ice castle just opened up in wisconsin. for one thing, it looks fantastic. that is so beautiful there. some cold, hard facts. it's built entirely from ice. it has tunnels, fountains, slides, like any proper castle should have, roads. this year got pushed back due to warmer temperatures. it took eight weeks to complete that.

san francisco. so as you get dressed this morning, you take a look out the window. yeah, it's still cold. later on today you might want to make sure you're wearing comfortable shoes because you'll want to spend more time outside. looking at our highs today for the south bay, gilroy heading to 64 degrees. east bay temperatures reaching 64 in concord. oakland today 62 degrees. also 62 in san mateo, daly city 59. 60 will be the high in the mission district again today. nor novafteau for novato, 62. not bad. the satellite imagery, we've seen a change of clouds. still we have high pressure in control. there will be a few more clouds moving in as we go into the weekend but they will be high clouds not looking at any rain. it's going to give us a filter of sunshine. looking at some low 60s for our high for the inland valleys, upper 60s for the weekend, it is going to be so nice, even through next wednesday. i'm not seeing any rain chances

in the forecast, although we may see some weather systems developing and moving our way by next weekend. this weekend is looking good. i'm making plans to get out there, mike. here is a look at the forecast. how are the roads looking? >> they are looking great because of a great forecast. we are forecasting a smooth drive for roadways closer to the water, closer to the bay. a longer drive out here coming in out of the altamont pass westbound. slows eastbound. that's where we have the crack, eastbound 205 off the split. also coming up of 80, sheridan, traffic may be down to one lane, possibly closed in the northbound direction. it's not clear based on two of the reports i'm seeing a little conflicting. watch for the detour heading north from fremont into sunol. over here highway 4, dog watch, paw patrol, highway 4 around bailey, reports of a dog on the side of the road. it's there. it's going to be dark in the area. just be careful and we may have an update hopefully.

>> we have currently too many schools across the city with regard to how many students we have. we have about 37,000 students. we still operate the same number of schools, roughly the same number of schools we did when we had 50,000 students. >> roots academy shares the campus with other prep schools. if the board decides to close at the end of the school year, students would be dispersed to other middle schools in the city. >> roots is a place where every single one of them is loved for who they are. >> in the circle, protesters put down their signs and told board members why they loved their school. >> when i came to roots, i was -- i felt like i had hope that i was going to be something in life. >> able to hear from the community, from the students and teachers directly, so the next stop is having a series of conversations before a final vote is made. >> reporter: school board members will be back here on monday. that's when they will make a

walnut creek man who felt he was fooled while buying a high-end fridge and freezer. >> 4:53. nbc bay area responds to a walnut creek man who felt he was fooled trying to buy a high-end frig and freezer. >> consumer investigator chris chmura with the most expensive case his team handled. >> good morning. cynthia was looking forward to the arrival of her new bedroom set. but she didn't expect this. that is her balcony and that is damage she says the delivery truck did when it knocked several boards loose. the apartment management said she was responsible for the repairs which cost nearly $4,000. cynthia went ahead and paid it, then asked the furniture store to reimburse her, but they said they weren't responsible. they said the delivery service they hired was. cynthia said she went back and forth to the furniture store for 10 months, then she turned to us
